Reservation policy politically sensitive topic hai, lekin legal lens se courts kuch clear principles follow karte hain. Jab koi quota system challenge hota hai – education, jobs, promotions – to court emotional debate nahi, constitutional tests apply karti hai.
Key questions:
- Kya classification reasonable hai? (Based on backwardness, representation etc.)
- Kya data/commission reports proper hai ya sirf political statement?
- Kya total reservation limit constitutional boundaries (jaise ceiling concept) ke andar hai?
- Kya creamy layer, economic/ social indicators properly consider hue?
Courts policy choice me normally interfere kam karti hain, jab tak policy clearly arbitrary ya equality principle ke against na ho. Lekin jab government data-less, hurried ya vote-bank style decisions leti dikhe, to judicial review active ho sakta hai.
Individual aspirant ke liye ground ye ho sakta hai ki unka existing right suddenly wipe out hua, merit list disturb hui, ya middle of process rules change hue. Tab fairness and legitimate expectation ka angle bhi aata hai.
Reservation ke pure debate me law ek balance dhundne ki koshish karta hai: social justice bhi rahe, merit aur equality bhi compromise na ho.
