Compounding of Offences: When Criminal Cases Can Be Legally Settled

Kuch criminal offences aise hote hain jinko law allow karta hai ki parties mil baith ke compromise karein, aur court case close kar de – isse bolte hain compounding. Typical examples: minor hurt, simple cheating, small financial disputes, some matrimonial disputes (depending on statute).

Compounding ka idea ye hai ki har matter jail tak pahunchana zaroori nahi, especially jaha victim ready hai settlement ke liye aur offence society-wide impact wala nahi. Court bhi yaha dekhta hai ki compromise voluntary, fair aur without pressure ho.

Har offence compoundable nahi hota. Kayi serious offences – rape, dacoity, large-scale fraud, public offences – normally non-compoundable hote hain, jaha State ka interest private compromise se upar rakha jata hai. Kabhi-kabhi High Court inherent powers use karke exceptional cases me settlement ko consider kar sakta hai, par ye narrow route hai.

Compounding se accused ka acquittal ho jata hai, future me same case revive nahi hota. Isliye victim ko bhi carefully sochna chahiye ki kya settlement long term me acceptable feel hoga.
