Limitation Period in Civil Cases: How Delay Can Legally Kill a Genuine Claim

Civil law ka ek silent killer hai – limitation period. Matlab, aapka claim sach bhi ho, documents strong bhi ho, phir bhi agar aapne case time se file nahi kiya, court keh sakti hai “time-barred, sorry”.

Har type ka claim ka apna limitation hota hai – contract recovery, property suits, declarations, etc. Ye typically kuch saal hota hai from the date cause of action arose (jaise payment due date, breach date, refusal date). Log aksar negotiation ke chakkar me saal nikal dete hain, aur jab relation completely toot jata hai tab lawyer ke paas jaate hain.

Court limitation ko favour karta hai because law chahata hai disputes timely resolve ho, stale claims na uthte rahein. Even agar doosri side limitation point raise na kare, court khud bhi consider kar sakti hai.

Isliye practical approach ye hai:

  • Dispute shuru होते hi dates note karo,
  • Written communication (email, WhatsApp, notice) maintain karo,
  • Aur limitation complete hone se pehle suit file kar do, chahe mediation later continue ho.

Limitation ek technical rule hai, lekin effect full and final hota hai. “Late but genuine” claim law me zinda nahi reh pata.
