Limitation Period in Civil Cases: How Delay Can Legally Kill a Genuine Claim

0

Civil law ka ek silent killer hai – limitation period. Matlab, aapka claim sach bhi ho, documents strong bhi ho, phir bhi agar aapne case time se file nahi kiya, court keh sakti hai “time-barred, sorry”.

Har type ka claim ka apna limitation hota hai – contract recovery, property suits, declarations, etc. Ye typically kuch saal hota hai from the date cause of action arose (jaise payment due date, breach date, refusal date). Log aksar negotiation ke chakkar me saal nikal dete hain, aur jab relation completely toot jata hai tab lawyer ke paas jaate hain.

Court limitation ko favour karta hai because law chahata hai disputes timely resolve ho, stale claims na uthte rahein. Even agar doosri side limitation point raise na kare, court khud bhi consider kar sakti hai.

Isliye practical approach ye hai:

  • Dispute shuru होते hi dates note karo,
  • Written communication (email, WhatsApp, notice) maintain karo,
  • Aur limitation complete hone se pehle suit file kar do, chahe mediation later continue ho.

Limitation ek technical rule hai, lekin effect full and final hota hai. “Late but genuine” claim law me zinda nahi reh pata.

Specific Performance in Property Deals: When Courts Force a Party to Honour a Contract

Property deal sign ho gaya, Agreement to Sell ban gaya, advance payment ho gaya, lekin seller last moment pe mukar gaya – yaha specific performance ka concept aata hai. Is remedy me court seller ko force kar sakti hai ki wo agreement follow kare aur final sale deed execute kare.

Ye remedy tab consider hoti hai jab contract clear, written, legal and certain ho. Buyer ko dikhana padta hai ki usne apna part fulfill kiya (ya ready-willing tha) – jaise payment arrange ki, deadlines meet ki, repeated reminders diye. Agar buyer khud defaulting party ho, to specific performance milna mushkil ho jata hai.

Court ye bhi dekhti hai ki property unique hai, market mein easily replaceable nahi, aur damages (sirf paisa) se justice nahi hoga. Property cases me generally courts मानती hain ki har property unique hoti hai, isliye specific performance logical remedy hai.

Lekin agar seller ne property third party bona fide purchaser ko bech di, ya kuch legal restrictions aa gaye, to complexity badh sakti hai. Kuch cases me court compensation/ refund + interest order karti hai instead.

Isliye Agreement to Sell draft karte waqt dates, consideration, possession, default clauses clear rakhna future litigation ko manageable bana deta hai.

Small Claims in Civil Court: When a Low-Value Suit Still Makes Legal Sense

Log sochte hain ki chhote amount ke liye civil court jaana “waste of time” hai. Lekin small claims ka apna importance hota hai, especially jab principle, record aur future risk ka angle ho.

Agar koi client, tenant, customer ya dost aapse paisa le kar wapas nahi de raha aur amount 10–50k, 1 lakh range ka hai, to legal notice + small claim suit dava ko serious bana deta hai. Ye message bhi jaata hai ki aap free mein default tolerate nahi karte. Kabhi-kabhi sirf notice aate hi saamne wala compromise kar leta hai.

Small value matters me bhi limitation period apply hota hai – matlab case certain time ke andar file karna hota hai, nahi to claim time-barred ho sakta hai. Isliye “chhodo yaar, dekh lenge” attitude long term mein nuksaan kar sakta hai.

Yes, cost, time, lawyer fee sab evaluate karna chahiye. Kayi jagah simplified procedure, lok adalat, mediation, ya summary suits available hote hain jisse process thoda fast ho sakta hai. Agar written documents, receipts, chats, UPI proof sab clear hai, to case aur strong ho jata hai.

Bottom line: sirf amount nahi, pattern bhi dekhna chahiye. Repeat default karne wale logon ke against ek strong example future fraud ko kam kar sakta hai.
